The process to follow in order to separate from your partner is the following:
- If you are not married, you are only de facto united without registration in the National Registry of Persons, you are only de facto separated as well, as long as there are no minor children, and nothing happens.
- If you are not married but there are minor children, child support must be set, so you will have to file a child support lawsuit. If you are a woman and you are a man, you can negotiate with your partner for child support, and if you do not do so, you will have to wait for your partner to file a lawsuit, from which you will go to defend yourself.
- If you are married, you will have to think if you want to get a divorce, AND you will seek legal advice, to process the divorce, or you can also just separate, which has to go to a court to make the agreement or get the respective sentence.
- If there are minor children, the man must provide a guarantee of alimony, otherwise the divorce does not proceed.
- And other requirements that will be indicated depending on the case, because not all cases are the same.
