In civil matters, the lawyer's profession is practiced for the assistance of any of the parties to the proceedings, such as: assistant lawyer to the plaintiff, assistant lawyer to the defendant or third parties.
In civil matters in Guatemala several types of lawsuits are processed, among the most common are:
Ordinary trials: these are the trials that do not have any denomination, do not have a time limit for their presentation, but it is the assistant lawyer of the plaintiff who analyzes the norm, and makes the respective presentation.
Summary trials: these are the trials that are totally classified in the Guatemalan civil procedural law, through which one must claim rights that every person has, they have a specific matter to process them, and from this classification one cannot get out.
Executive trials: are the trials that arise as a consequence of the existence of executive titles, these executive titles are: testimonies of public deeds, sentences, orders or resolutions, that order a certain action or obligation to be fulfilled by a person.
All these trials have different phases, within which they are found:
1) The demand:It is the writing, in which the statement or rights of the actor, or plaintiff, is made, offering the respective evidence and making the respective request.
2) The answer to the complaint: It is the document in which the opposition or disagreement of the defendant is made, responding to the statements of the actor in his complaint, so he must also offer evidence to prove what he claims.
3) Proceedings: This is a stage of the civil process, in which the means of proof offered in the lawsuit and answer to the lawsuit are examined, each one supporting and proving their respective thesis or hypothesis, which must be evaluated in the sentence, in order to obtain a sentence that accepts or does not accept the lawsuit or answer to the lawsuit. And this is mostly done in written form.
4) Sentence: This is the document issued or dictated by the judge who hears the case, which summarizes the statements of the plaintiff and the defendant, and on the basis of the total analysis dictates a sentence accepting or not the complaint and answer.
5) Contestations: It is the means by which the resolutions issued by the judge are contested, to be confirmed, revoked.
